Affiliate Terms of Use

These Affiliate Program Terms of Use govern your participation in TheDuchy affiliate program. By submitting an affiliate application you agree to be bound by these terms. TheDuchy, LLC may amend these terms at any time; continued participation after a change constitutes acceptance of the revised terms.

Approval or Rejection of Application

TheDuchy reserves the sole and discretionary right to approve or reject any affiliate application for any reason. Rejection of an application creates no legal recourse for the applicant.

Commissions

Commissions are paid monthly. A referred account must remain active for a minimum of 37 days before the associated commission becomes payable. Self-referrals and commissions on your own membership are not eligible. Only successfully completed transactions qualify — chargebacks and refunded transactions receive no payout, and any commission already paid on a subsequently refunded or charged-back transaction may be reclaimed.

Termination

Your affiliate status may be suspended or terminated for, among other things: misleading or deceptive advertising; spamming; promoting illegal activity; failing to disclose the affiliate relationship as required by FTC guidelines; intellectual-property violations; offering rebates or kickbacks funded by your commissions; fraudulent transactions; or any other violation of this agreement.

Affiliate Links

You may promote TheDuchy using the graphics and text we provide, or appropriate alternatives you create, across websites, social media, and print advertising. Any public post promoting TheDuchy must include a clear and transparent disclosure that you earn a commission on referrals.

Pay-Per-Click Policy

Pay-per-click (PPC) bidding on TheDuchy brand terms is not allowed without prior written permission from TheDuchy.

Liability

TheDuchy disclaims liability for tracking failures, loss of database information, or any other damages arising from the affiliate program. The program is provided without warranties of any kind, express or implied, including as to its operation, the accuracy of membership records, or error-free functioning of the website.

Term of Agreement

This agreement takes effect upon acceptance of your application and continues until your affiliate account or the program is terminated. Modifications to these terms apply automatically; continued participation constitutes acceptance.

Indemnification

You agree to indemnify and hold harmless TheDuchy, LLC against any liabilities, damages, claims, and legal expenses arising from your negligence, misrepresentation, non-disclosure, or misconduct in connection with the affiliate program.

Electronic Signatures

Completing and submitting an affiliate application creates a legally binding electronic signature equivalent to a handwritten authorization of these terms.
